An agreement for using our work
These terms govern your use of facesofimpact.org and any page, service or material we make available through it. By using the site, you accept them. If you do not accept them, please do not use the site.
Agreement
Faces of Impact Foundation is a nonprofit corporation incorporated in Delaware and recognized by the Internal Revenue Service as a tax-exempt public charity under Section 501(c)(3) of the Internal Revenue Code (EIN 39-2418674). In these terms, “we” and “us” mean Faces of Impact Foundation.
Using the site
You are welcome to read, share and link to our work. Please do not use the site for any unlawful purpose, or in any way that damages it or interferes with anyone else’s use of it; attempt to gain access to any part of the site, account or system not intended for you; or misrepresent yourself as connected to, endorsed by, or speaking for Faces of Impact Foundation.
Our photographs, films and writing
Everything on this site — photographs, films, interviews, articles, exhibition materials, design, and the arrangement of it all — is owned by Faces of Impact Foundation or by our photographers and contributors, and is protected by copyright and other intellectual property laws. Our name, logo and the mark FACES OF IMPACT are our trademarks.
The portraits are the heart of this organization’s work and we protect them carefully.
Automated access, scraping and machine learning
You may not use any automated system to scrape, harvest, copy or index the contents of this site except for search engine crawlers operating in accordance with our robots.txt file. You may not use any material from this site — in particular the photographs, films and interview transcripts — to train, fine-tune or otherwise develop any machine learning model or artificial intelligence system without our express written permission.
Nominations and things you send us
If you nominate someone, apply to work with us, or send us any idea, suggestion or material, you confirm that you have the right to send it, and that you have the nominee’s knowledge and agreement where the nomination includes their personal information. You keep ownership of what you send. You give us a non-exclusive, royalty-free, worldwide licence to use it for the purpose you sent it for — assessing a nomination, considering an application, or responding to your message. A nomination is not a commitment on our part. We consider many more people than we are able to document.
Donations
Donations to Faces of Impact Foundation are voluntary and, as a general matter, non-refundable. If a gift was made in error or processed incorrectly, contact us and we will make it right. We will send a written acknowledgment for every gift, and for gifts of $250 or more the acknowledgment will contain the information required to claim a deduction. Contributions are tax-deductible in the United States to the extent permitted by law. We cannot advise you on your own tax position — please speak to your tax adviser.
Links and information on this site
We link to the websites and work of the people and organizations we document. We do not control those sites and are not responsible for their content, accuracy, or how they handle your information. We publish our work carefully and in good faith. Biographies, interviews and descriptions reflect the information available to us at the time of publication, and circumstances change. Nothing on this site is professional, legal, medical or financial advice. The site is provided as it is, without warranties of any kind about availability, accuracy or fitness for a particular purpose.
Limitation of liability and indemnity
To the fullest extent permitted by law, Faces of Impact Foundation, its directors, officers, advisors, contributors and volunteers will not be liable for any indirect, incidental, special or consequential loss arising out of your use of this site. Nothing in these terms limits any liability that cannot lawfully be limited. You agree to indemnify Faces of Impact Foundation against any claim arising from your misuse of the site or your breach of these terms.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Delaware, and you agree to that jurisdiction.
Changes and contact
We may revise these terms. The version posted here, with its effective date, is the one that applies. Continuing to use the site after we post a change means you accept it.
